Alberta’s trans advocates raise alarm over potential use of notwithstanding clause

In Alberta, the government seems poised to use the notwithstanding clause to defend laws that govern the use of pronouns in schools, female sports and gender-affirming health care.

If applied, it would mark the second time in a month that Premier Danielle Smith uses the constitutional clause.

In late November, her government invoked the notwithstanding clause to end a three-week teachers strike.
