How does Trump have the power to send troops into American cities?
It all started with a man who lost his horse 200 years ago. During the War of 1812, a man named Jacob Mott refused to join the army after President James Madison called up the militia.
Because Mott didn’t go, the government fined him and took away his gray mare to pay for it. Mott sued, arguing the president didn’t have the right to call up state soldiers without congressional approval.
But in 1827, the Supreme Court ruled against him in the Martin vs. Mott case, saying the president alone can decide when to use the militia, and that courts can’t question that decision.
Now that same 200-year-old precedent is back, as the Supreme Court considers whether President Trump can deploy the National Guard into Illinois even if the governor says no.
